Overview of legislation in the field of the building authority for nuclear facilities

Acts:

• Act No. 541/2004 Coll. on the Peaceful use of nuclear energy (Atomic Act) and on the amendments and supplements to some acts as amended effective from 1 April 2024
• Act No. 50/1976 Coll. on Land use Planning and Building Regulations (Building Act) as amended effective until 31. March 2025 ( The New Building Act establishes the conditions after which the procedures for the construction of nuclear installations and construction related to nuclear facilities on the premises of a nuclear facility will continue to proceed after 31 March 2025 according to the current regulations as amended until 31 March 2025.)
• Act 25/2025 Coll. Building act and on amendments and supplements to certain acts as amended by Act No. 77/2025 Coll.
• Act No. 200/2022 Coll. on spatial planning as amended effective from 1. April 2025
• Act No. 172/2022 Coll. amending and supplementing Act. No. 575/2001 Coll. on organization of governmental activities and of central state administration as amended and which amends and supplements certain acts

According to Sec. 84, par. 12 -14  – Transitional provisions of the Act No. 25/2025 Coll. Building Act and on amendments and supplemenets to certain acts (Building Act):

(12) Proceedings for the issuance of the authorization for a construction, proceedings for the issuance of the authorization to change a building structure before completion, proceedings for the issuance of the authorization to change the purpose of the use of the construction, proceedings for the issuance of the authorization for an early use of a constructure, proceedings for the issuance of a permit for temporary use of a structure for trial operation, proceedings for the issuance of a final approval of the building and proceedings for the issuance of a permit to remove a structure for nuclear installation structures and structures related to a nuclear installation on the premises of a nuclear installation or partly on the premises of a nuclear installation, initiated and not legally completed at the Nuclear Regulatory Authority by 31 March 2025, shall be completed at the Nuclear Regulatory Authority in accordance with the current regulations. Proceedings under the first sentence shall be subject to Act No. 50/1976 Coll. on spatial planning and building regulations (Building Act) as amended, effective until 31 March 2025, its implementing generally binding legal regulations effective until 31 March 2025 and Act No. 541/2004 Coll. on the peaceful use of nuclear energy (Atomic Act) and on amendments and supplements to certain acts, as amended, effective until 31 March 2025, and generally binding legal regulations for its implementation, as amended, effective until 31 March 2025. Documentation for procedures pursuant to the first sentence shall be prepared in accordance with generally binding legal regulations effective until 31 March 2025.

(13) Proceedings for the issuance of the authorization for a construction, proceedings for the issuance of the authorization to change a building constructure before completion, proceedings for the issuance of the authorization to change the purpose of use of the construction, proceedings for the issuance of the authorization for an early use of a structure, proceedings for the issuance of a permit for temporary use of a structure for trial operation, proceedings for the issuance of a final approval of the building and proceedings for the issuance of a permit to remove a structure for nuclear installation structures and structures related to a nuclear installation on the premises of a nuclear installation or partly on the premises of a nuclear installation for which a valid zoning decision was issued by 31 March 2025 according to the current regulations after 31 March 2025, the Nuclear Regulatory Authority shall commence and complete the proceedings according to the current regulations. Act No. 50/1976 Coll. on spatial planning and building regulations (Building Act) as amended applies to the proceedings according to the first sentence, effective until 31 March 2025, its implementing generally binding legal regulations as amended, effective until 31 March 2025 and Act No. 541/2004 Coll. on the peaceful use of nuclear energy (Atomic Act) and on amendments and supplements to certain acts, as amended, effective until 31 March 2025, and generally binding legal regulations for its implementation, as amended, effective until 31 March 2025. Documentation for procedures pursuant to the first sentence shall be prepared in accordance with generally binding legal regulations effective until 31 March 2025.

(14) The sitting of a nuclear installation structure for which an approval was issued by the Nuclear Regulatory Authority by 31 March 2025 pursuant to the Atomic Act and the location of a structure related to such a nuclear installation shall be subject to Act No. 50/1976 Coll. on Spatial Planning and Building Regulations (Construction Act), as amended by later acts, in the version effective until 31 March 2025. A proposal for the issuance of a spatial decision for structures pursuant to the first sentence may be submitted by 31 March 2027. The documentation for the proposal for the issuance of a spatial decision for the construction of a nuclear installation and structures related to a nuclear installation shall be prepared pursuant to a special decree (decree no. 453/2000 Coll.) in the version effective until 31 March 2025. The regional spatial planning and construction office shall be competent for the territorial proceedings for the construction of a nuclear installation and structures related to a nuclear installation pursuant to this paragraph. The provisions on procedures for the authorization for a construction, proceedings for the issuance of the authorization to change a construction structure before completion, proceedings for the issuance of the authorization to change the purpose of use of the construction, proceedings for the issuance of the authorization for an early use of a constructure, procedures for issuing the authorization for the trial operation of a building and proceedings for the issuance of a final approval of the building pursuant to Act No. 50/1976 Coll. on spatial planning and building regulations (Building Act), as amended, in the version effective until 31 March 2025, shall apply to buildings for which a zoning decision has been issued pursuant to the first sentence. The proposal to initiate proceedings pursuant to the fifth sentence may be submitted until 31 March 2032. The documentation for the proposal to initiate proceedings pursuant to the fifth sentence shall be prepared in accordance with a specific decree (decree 453/2000 Coll.) in the version effective until 31 March 2025. The competent authority for proceedings pursuant to the fifth sentence is the Nuclear Regulatory Authority.
