According to the § 11 par. 1 of Atomic Act, according to the Article 2 par. (4) of the Commission’s Regulation (EURATOM) No. 302/2005 on application of safequards system (EURATOM) and in compliance with the Article No. 197 special fission materials, Uranium enriched by Uranium 235 or Uranium 233, source materials and ores are understood under the term nuclear materials, while:
- “Special fission materials” mean Plutonium 239, Uranium 233, Uranium enriched by uranium 235 or Uranium 233 and all materials containing one or more of above mentioned isotopes and such other fission materials that can be determined by the Board through the decision of qualified majority based on the proposal of Commission. The term special fission materials do not, however, cover source materials.
- “Uranium enriched by Uranium 235 or Uranium 233” means Uranium containing Uranium 235 or Uranium 233 or both in such a quantity that relative ratio of sum of these two isotopes to isotope 238 is higher than ratio of Uranium 235 to isotope 238 existing in the nature.
- “Source materials” means Uranium containing a mixture of isotopes as it exists in the nature; Uranium, in which the contents of Uranium 235 is less than usually; Thorium; all above mentioned elements in a form of metal, alloy, chemical compounds or concentrate; all other materials containing one or more of above mentioned elements in such a concentration, which will be determined by Board through its decision by qualified majority based on proposal of commission.
- “Ores” means all ores containing materials, from which the above defined source materials can by obtained by chemical or physical processes in such an average concentration as determined by the Board through the decision by qualified majority based on proposal of commission.
It can be stated for clarification that in the Slovak Republic the nuclear material can be, besides nuclear fuel, found in the form of shielding made from depleted Uranium used as shielding for sources of ionising radiation (various defectoscopy equipment, level meters, medical devices, etc.). Also chemical compounds, neutron sources (Pu-Be neutron sources) etc., can be involved in.
